Standard Business Conditions

§ 1 Scope, Customer Information

The following Standard Business Conditions (SBC) govern the contractual relationship between:

and consumers purchasing goods from our shop. These SBC contain customer in formation according to the BGB-Infoverordnung. The contract language is German.
 
§ 2 Conclusion of contract

The offer in the internet represent a non-binding invitation to order goods. By filling in your data and clicking the order button you place a binding offer for the conclusion of a sales contract. We reserve the right to accept your offer within three days by sending you an order confirmation by email. On without effect expiry of the above-mentioned period your offer counts as rejected i.e. you are no longer bound by your offer.

§ 3 Customer information: Saving of offer-text

We save the text of your order including the details of the articles ordered. You have no access to this text of the contract.

§ 4 Customer information: changes to order

You can correct your details at any time before submitting your order. We inform you of the possibilities to correct your order during the order process.

§ 5 Revokement advice, Right of withdrawal

Purchaser may revoke the order within a revocation period of two weeks without further specification of reasons in written form (letter, fax or email) or by returning the goods. The revocation period starts before the delivery and the receipt of this instruction. For repeat orders of identical goods not before receipt of the first consignment and also not before fulfilment of our duty to supply information in accordance with § 312c Abs. 2 BGB in connection with § 1 Abs. 1, 2 und 4 BGB-InfoV as well as our duties in accordance with § 312e Abs. 1 Satz 1 BGB in connection with § 3 BGB-InfoV. Punctual dispatch suffices as compliance with the time limit. The revocation must be declared to:

§ 6 Consequences of Withdrawal

In case of an effective revocation, any performance received by one party is to be returned to the respective other, as are benefits derived from such performance, e.g. interest. If Purchaser cannot return the goods received in whole or in part, or if Purchaser can only return the received goods in a deteriorated state, Purchaser must pay compensation for value insofar. There is no obligation to pay compensation for value if the sole cause of deterioration of the good(s) received was the inspection of the respective good(s) as would have been possible in a retail shop. For the rest, Purchaser can avoid paying compensation for value in respect of deterioration in the good(s) as a result of their/its proper use, if Purchaser does not use the good(s) the way Purchaser uses Purchaser's own property and refrain from doing anything that would curtail the value of the good(s). If the value of the order does not exceed Forty Euros (EUR 40) and the good(s) delivered correspond to the good(s) Purchaser ordered or if by a higher price for the goods the Purchaser has not paid as agreed in the contract at the time of withdrawal., Purchaser must bear the costs of the return. Otherwise return of the goods is free of charge fort he purchaser. Items that cannot be sent by mail will be collected at the purchaser’s place of business. The duties related to the repayment or rebates must be fulfilled within 30 days. The deadline starts with your despatch of your cancellation request or the item in question; for us it starts with our receipt of the same.

§ 7 Return charges

Should the consumer exercise their right according to paragraph 6 of these SBC then they have to bear the normal costs of returning the goods if the goods delivered conform to the order and the cost of return does not exceed 40 euros or when the price is higher, the service in return of the consumer or a contractually fixed part payment has not been made. The normal costs are defined as the cost of standard parcel post. Any additional costs arising from sending the goods to another location than our company address at the time of your order or the use of a collection service are not born by you (the consumer).

§ 8 Retention of ownership

The goods remain our property until full payment has been effected.

§ 9 Limitation of your guarantee claims

Any claims for defects of used goods are barred after one year of receipt of goods. This regulation excludes claims for damages, claims due to defects we have maliciously concealed and claims arising from a guarantee we have accepted regarding the quality of the goods. The statutory limitation applies in these exceptional cases.

§ 10 Limitation of liability

We eliminate liability for slightly negligent breach of duty so far as they do not result in loss of life, body and health damage or culpable violation of a fundamental contractual obligation by us or our vicarious or lawful agents. Our main contractual duties are to deliver the goods and to transfer the right of ownership to you. In addition we have to provide the goods free of material and title defects.
